1. Scope

This Policy explains:

  • when an NFT purchase may be cancelled;
  • when a blockchain transaction becomes final;
  • when you may be eligible for a refund;
  • which costs are generally non-refundable;
  • how to submit a refund or cancellation request.

This Policy does not limit any mandatory consumer or statutory rights that apply to you and cannot lawfully be excluded.

2. How NFT purchases are completed

NFTs may be purchased and minted through one or more blockchain networks supported by the Company and shown at checkout.

A purchase may require you to:

  • connect a compatible blockchain wallet;
  • select the correct blockchain network;
  • review the NFT and transaction details;
  • approve or sign a transaction through your wallet;
  • pay the NFT price and applicable gas or network fees.

Unless stated otherwise, the NFT is minted at or following the time of purchase and is not pre-minted specifically for you in advance.

A purchase is generally completed when:

  • the relevant transaction is successfully confirmed on the applicable blockchain; and
  • the NFT is minted to or otherwise delivered to the wallet address connected with the purchase.

3. Cancellation before transaction submission

You may abandon or cancel the checkout process before you approve or submit the blockchain transaction through your wallet.

If no transaction has been submitted and we have not received any payment, no purchase is completed and no refund is required.

Closing the Website, disconnecting your wallet, or leaving checkout does not necessarily cancel a transaction that has already been submitted to a blockchain network.

4. Pending blockchain transactions

After a transaction has been submitted to a blockchain network, we may be unable to cancel, reverse, accelerate, or otherwise control it.

A transaction may remain pending because of:

  • blockchain congestion;
  • validator or node delays;
  • gas or network fee settings;
  • wallet provider issues;
  • smart contract processing;
  • network outages or technical failures.

A pending transaction is not necessarily a completed purchase.

You should not submit a duplicate transaction while the original transaction remains pending unless the Website or our support team clearly instructs you to do so.

We are not responsible for duplicate purchases caused by a user independently submitting or approving the same transaction more than once.

5. Finality after minting or blockchain confirmation

Blockchain transactions may be irreversible once confirmed.

Subject to mandatory applicable law, an NFT purchase is generally final once:

  • the blockchain transaction has been confirmed;
  • the NFT has been minted or delivered to the wallet used for the purchase; or
  • supply of the relevant digital content has otherwise begun at your express request.

After that point, you generally cannot cancel the purchase merely because:

  • you changed your mind;
  • you no longer want the NFT;
  • you selected the wrong NFT;
  • you expected different market demand or resale opportunities;
  • the NFT price or cryptocurrency value changed;
  • gas or network fees were higher than expected;
  • a third-party marketplace, wallet, explorer, or indexer does not display or support the NFT;
  • you are unable to sell or transfer the NFT.

6. Immediate minting and statutory withdrawal rights

Depending on your country of residence, you may have a statutory right to withdraw from certain distance contracts.

Where permitted by applicable law, checkout may ask you to:

  • expressly request that minting and digital delivery begin immediately, before the end of any statutory cancellation period; and
  • acknowledge that once minting or supply begins, you may lose your statutory right to cancel or withdraw from the purchase.

Where applicable law does not permit a withdrawal right to be excluded or lost, your mandatory rights remain unaffected.

Nothing in this Policy automatically removes any statutory cancellation or withdrawal right unless the legal requirements for doing so have been satisfied.

7. Circumstances in which a refund may be available

Subject to verification and applicable law, you may be eligible for a full or partial refund where:

7.1 Payment received but NFT not delivered

We received the NFT purchase amount, but the NFT was not minted or delivered because of a verified technical failure within systems or smart contracts controlled by us, and we are unable to complete or remedy delivery within a reasonable time.

7.2 Verified duplicate payment

We received more than one payment for the same intended purchase because of a verified error in the Website or purchase flow.

Repeated transactions separately initiated, signed, or approved by the user are not automatically treated as a technical duplicate.

7.3 Incorrect NFT supplied because of our error

A different NFT was minted or delivered because of a verified error attributable to us, and we cannot correct the issue or provide the NFT described at checkout within a reasonable time.

7.4 Material non-conformity or defect

The NFT or associated digital content materially fails to conform to the description provided at the time of purchase, and applicable law requires a remedy.

Where permitted by applicable law, we may first offer an appropriate remedy, such as:

  • correction of metadata;
  • restoration of access or display;
  • repair of a technical defect;
  • delivery of the correct NFT;
  • replacement;
  • an appropriate price reduction.

A refund may be provided where the defect cannot be remedied, a remedy is impossible or disproportionate, the remedy is not completed within a reasonable time, or applicable law otherwise requires a refund.

7.5 Cancellation by us before completion

We cancel a purchase before successful minting or delivery because of a pricing error, technical failure, collection withdrawal, legal restriction, or other issue attributable to the Website or project.

7.6 Mandatory legal rights

A refund, price reduction, cancellation, or other remedy is required under applicable consumer protection or other mandatory law.

7.7 NFT unavailable after payment

We received the purchase amount, but the selected NFT cannot be minted or delivered because the available supply was exhausted, another transaction for the same NFT was confirmed first, the Website incorrectly displayed the NFT as available, or another verified availability error occurred.

In such circumstances, we will:

  • refund the purchase amount actually received by us; or
  • offer another NFT or another appropriate solution, but only with your express agreement.

We will not automatically substitute a different NFT without your consent.

Gas fees, network fees, validator fees, and other charges paid directly to the relevant blockchain network or third-party infrastructure may remain non-refundable because we do not receive or control those fees, except where reimbursement is required by applicable law.

8. Circumstances that are generally not refundable

Subject to mandatory applicable law, refunds are generally not provided for:

  • a change of mind after minting or blockchain confirmation;
  • selecting the wrong NFT;
  • selecting the wrong blockchain network;
  • connecting the wrong wallet;
  • providing or approving an incorrect wallet address;
  • approving an incorrect transaction;
  • losing access to a wallet;
  • losing a private key, seed phrase, recovery phrase, password, or device;
  • insufficient wallet funds;
  • failure to maintain sufficient gas or network fees;
  • a transaction rejected or cancelled through your wallet;
  • a transaction failure caused by a wallet, network, validator, node, or third-party provider;
  • delays caused by blockchain congestion;
  • cryptocurrency price or exchange-rate fluctuations;
  • changes in market conditions;
  • lack of buyer demand;
  • inability to resell, list, transfer, or trade an NFT;
  • lack of support by a third-party marketplace, wallet, explorer, indexer, gateway, or service;
  • dissatisfaction with rarity, collection status, curatorial classification, or perceived market value;
  • removal or restriction resulting from your breach of the Terms of Service;
  • interactions with fake websites, fake collections, unofficial smart contracts, phishing links, or impersonation accounts.

9. Gas and network fees

Gas fees, network fees, validator fees, priority fees, and similar blockchain charges are imposed by blockchain networks and infrastructure providers, not by History Stamps.

These fees may be charged even where a transaction:

  • fails;
  • is rejected;
  • remains pending;
  • is replaced;
  • is not completed;
  • is submitted to the wrong network;
  • does not result in a successful NFT mint.

Gas and network fees are generally non-refundable because we do not receive or control them.

Where applicable law specifically requires us to reimburse a fee, we will comply with that requirement.

10. Refund amount and cryptocurrency fluctuations

Where a refund is approved, the refund will normally be based on the purchase amount actually received by us for the relevant transaction.

If payment was received in cryptocurrency or another digital asset, the refund will normally be calculated using the number of units of that digital asset actually received by us, rather than its fiat value at the time of the refund.

For example, if we actually received 0.1 ETH for the relevant purchase, an approved refund would normally be based on 0.1 ETH, subject to any deductions or adjustments permitted under this Policy and applicable law.

Unless applicable law requires otherwise:

  • gas and network fees paid to third parties are excluded;
  • we do not compensate for increases or decreases in cryptocurrency value;
  • we do not compensate for exchange-rate movements;
  • we do not compensate for lost profits, expected resale value, or lost market opportunities;
  • no administrative fee will be charged for a refund required by law or resulting from our verified error.

Where technically and legally possible, a refund may be returned:

  • in the same digital asset used for the purchase;
  • to the same wallet address from which payment was received; or
  • through another lawful method agreed with you.

We may use a different refund method where returning the same digital asset or sending funds to the original wallet is unlawful, technically impossible, unsafe, prohibited by sanctions or compliance requirements, or otherwise inappropriate in the circumstances.

The exact refund method may depend on the blockchain network, sanctions and compliance requirements, wallet compatibility, technical limitations, and applicable law.

11. NFT status following a refund

Where technically and legally possible, we may require the NFT to be:

  • returned to a wallet designated by us;
  • transferred back through an approved transaction;
  • burned;
  • disabled or marked as refunded within systems controlled by us; or
  • otherwise dealt with as reasonably necessary to prevent the user from retaining both the NFT and the refunded purchase amount.

You must not transfer, sell, encumber, or otherwise dispose of an NFT after submitting a refund request where such action would prevent an appropriate refund remedy.

We will not ask you to transfer an NFT or approve a wallet transaction without first providing instructions through an official History Stamps communication channel.

We will never ask for your private key or seed phrase.

12. Allegedly unauthorized wallet transactions

If you claim that a blockchain transaction was approved or submitted without your authorization, you should contact us promptly and provide the transaction hash, wallet address, blockchain network, and any available supporting information.

We may investigate the circumstances, but we do not guarantee a refund merely because you state that a transaction was unauthorized.

Blockchain transactions are generally executed after a transaction or message has been approved through the relevant wallet. We may be unable to determine whether a wallet approval was provided by you, another person with access to your device or wallet credentials, malware, a compromised browser extension, or another unauthorized party.

Subject to mandatory applicable law, we are generally not responsible for unauthorized transactions resulting from:

  • loss or disclosure of a private key, seed phrase, recovery phrase, password, or device;
  • compromise of your personal wallet or wallet provider;
  • phishing, fake websites, malicious links, malware, or fake support accounts;
  • unsafe wallet permissions or approvals;
  • unauthorized access to your device, browser, email account, or wallet.

This does not exclude any remedy that may apply where the unauthorized transaction was caused by a verified security failure, technical defect, fraud, or misconduct within systems directly controlled by us, or where a refund or other remedy is required by applicable law.

We may request evidence reasonably necessary to investigate the transaction and may delay any refund while fraud, security, sanctions, wallet ownership, or compliance checks are completed.

13. Metadata changes, takedowns, and content restrictions

A correction, update, restriction, removal, or takedown of an NFT page, image, description, metadata element, or related content does not automatically create a right to a refund.

Such action may be required because of:

  • an intellectual property complaint;
  • a legal or regulatory requirement;
  • a rights-holder request;
  • a factual or metadata error;
  • a security concern;
  • sensitive content;
  • fraud or misuse;
  • a technical problem.

Any mandatory remedy will depend on the circumstances and applicable law.

14. Sanctions, fraud, and legal restrictions

We may delay, block, reject, or withhold a refund where reasonably necessary to:

  • comply with sanctions or asset-freezing requirements;
  • comply with a court order, regulator request, or legal obligation;
  • investigate suspected fraud, theft, money laundering, phishing, or unauthorized activity;
  • verify ownership or control of the relevant wallet;
  • prevent payment to a restricted person or wallet.

Where funds are required to be frozen, blocked, reported, or otherwise handled under applicable law, we may be unable to return them until legally permitted.

15. How to request a refund or cancellation

  • the wallet address used for the purchase;
  • the blockchain network;
  • the transaction hash;
  • the NFT or token ID;
  • the purchase date;
  • a description of the issue;
  • screenshots or other supporting evidence.

Do not send us your private key, seed phrase, recovery phrase, wallet password, or other wallet credentials.

Submitting a request does not guarantee that a refund will be approved.

16. Review and processing time

We will review refund and cancellation requests in good faith and may request additional information reasonably necessary to verify the transaction or issue.

Where applicable law establishes a refund deadline, we will process an approved refund within that legally required period.

In other cases, we will normally aim to process an approved refund within 14 business days after:

  • the request has been approved;
  • all required information has been received;
  • any required NFT return or remedial step has been completed; and
  • legal, sanctions, fraud, and compliance checks have been completed.

Blockchain congestion, network outages, wallet compatibility, legal restrictions, or third-party infrastructure may delay completion.

17. No limitation of mandatory rights

Nothing in this Policy excludes, limits, or replaces any mandatory consumer protection, digital content, conformity, cancellation, withdrawal, refund, repair, replacement, price reduction, statutory warranty, or other right that applies to you and cannot lawfully be excluded.

Where this Policy conflicts with mandatory applicable law, the mandatory law will prevail.

18. Changes to this Policy

We may update this Policy from time to time.

The version applicable to a purchase will normally be the version made available at the time the purchase was completed, except where a change is required by law or provides additional rights or protections to users.
